Terms of Service

These Terms of Service govern your access to and use of Pitchstack and any related websites, applications, features, content, and supporting services operated by Awlsring LLC. By accessing or using Pitchstack, you agree to be bound by these Terms.

If you use Pitchstack on behalf of a team, company, or other organization, you represent that you have authority to bind that organization to these Terms.

We may update these Terms from time to time in our discretion. When we do, we will post the updated version here and update the effective date shown on this page.

Your continued use of the Service after revised Terms become effective means you accept the updated Terms.

Some features of the Service may require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must provide accurate information when creating or maintaining an account. We may refuse registration, reclaim usernames, disable accounts, or restrict access at any time.

Pitchstack is a general-audience service and is not directed to children under 13.

The Service may allow you to create, upload, publish, organize, display, or otherwise submit content, including profiles, usernames, avatars, decks, collections, group content, notes, descriptions, tags, and other materials.

Profiles, decks, and collections on Pitchstack are public by default. Groups may be public or private depending on how they are configured.

You are solely responsible for your User Content and for the consequences of posting or sharing it. You represent and warrant that you own or control the rights necessary to submit and use that content on the Service, and that your User Content does not violate any law, contract, or third-party right.

We do not guarantee that any User Content will remain available on the Service.

You retain ownership of your User Content. By submitting User Content to the Service, you grant Pitchstack a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify as needed for technical operation, adapt, publish, display, perform, distribute, and otherwise use that User Content solely for the purpose of operating, improving, securing, promoting, and providing the Service.

This license includes the right to display your public User Content to other users and to the public, create backups and archival copies, and reformat or process User Content for technical compatibility.

This license ends within a commercially reasonable time after your User Content is deleted from the Service, except to the extent copies have been retained for backup, legal, security, compliance, or operational reasons.

If you provide suggestions, ideas, or feedback about the Service, you grant Pitchstack a non-exclusive, perpetual, irrevocable, royalty-free right to use that feedback for any lawful purpose without compensation or attribution to you.

The Service, including its software, design, branding, text, graphics, functionality, and other content provided by Pitchstack, is owned by Awlsring LLC or its licensors and is protected by applicable intellectual property laws.

Any third-party names, trademarks, logos, game content references, marketplace names, publisher references, or linked properties remain the property of their respective owners.

The Service may display or link to third-party content, websites, services, marketplaces, pricing data, status pages, social platforms, or other external resources.

Pitchstack may receive financial support through Metafy and may earn commissions or other compensation from affiliate links or partner relationships. Pitchstack participates in the TCGPlayer affiliate program and may earn commissions from qualifying purchases made through TCGPlayer links.

Card pricing, marketplace data, and product availability may be supplied by third-party sources. Pricing is provided for reference only and should be verified with the seller before purchase. Pitchstack does not control and is not responsible for third-party services, third-party policies, transaction outcomes, or the accuracy, availability, completeness, or timeliness of third-party data.

• You may not use the Service to violate any law or regulation.
• You may not infringe, misappropriate, or violate any third-party right.
• You may not impersonate any person or entity or falsely imply affiliation, endorsement, or approval.
• You may not submit false, deceptive, fraudulent, defamatory, abusive, harassing, hateful, or otherwise objectionable content.
• You may not upload malicious code, viruses, worms, spyware, or other harmful materials.
• You may not interfere with or disrupt the Service, its infrastructure, or other users' access.
• You may not probe, scan, test, or attempt to bypass security or access controls.
• You may not use bots, scrapers, crawlers, spiders, automation tools, bulk collection tools, or other means to extract, index, monitor, mirror, harvest, or copy data or content from the Service without our prior written consent.
• You may not use the Service to build, train, enrich, or support any competing database, model, service, or product without our prior written consent.
• You may not frame, mirror, reproduce, or republish substantial portions of the Service.

We may remove any User Content, suspend or terminate any account, restrict access to any feature, or take any other action with respect to the Service at any time, with or without notice, and for any reason or no reason.

Without limiting the foregoing, we may do so to protect the Service, users, third parties, our business, or legal compliance, or because we believe content or conduct is objectionable, risky, misleading, infringing, abusive, unlawful, or inconsistent with the intended use of the Service.

We are not obligated to host, maintain, restore, or return any User Content after removal, suspension, or termination.

We may modify, suspend, discontinue, or restrict all or any part of the Service at any time, temporarily or permanently, with or without notice.

We do not guarantee that the Service, or any content or feature, will always be available, accurate, secure, uninterrupted, or error-free.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHSTACK DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, PITCHSTACK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT, PRICING DATA, USER CONTENT, OR THIRD-PARTY DATA WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHSTACK, Awlsring LLC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF PITCHSTACK FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

You agree to indemnify, defend, and hold harmless Pitchstack, Awlsring LLC, and their respective officers, directors, members, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, expenses, and fees, including reasonable attorneys' fees, arising out of or relating to your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of Washington, without regard to conflict of law principles.

You and Pitchstack agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state courts located in King County, Washington, or the United States District Court for the Western District of Washington, if federal jurisdiction exists.

If you believe that content on the Service infringes your copyright or other intellectual property rights, please send a written notice to contact@pitchstack.gg.

Your notice should include enough information for us to identify the material at issue, the claimed rights, the basis for the complaint, and how to contact you. Pitchstack may remove allegedly infringing material, disable access, or take other action in its discretion.

These Terms constitute the entire agreement between you and Pitchstack regarding the Service and supersede prior or contemporaneous understandings relating to the Service.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms freely.
